Copyright and DMCA Policy

Last updated: 6 November 2026

1. Purpose and scope

Daryn Lab Inc. respects copyright and responds to sufficiently substantiated notices concerning content made available through Beyonder or customer applications. This Policy describes a notice-and-takedown process under the US Digital Millennium Copyright Act, 17 U.S.C. § 512, where applicable. It does not determine ownership of content or substitute for a court judgment.

Daryn Lab asserts rights in proprietary Beyonder code, architecture, interfaces, integration frameworks, original database structures, templates, documentation and improvements only insofar as protected by law and effectively acquired under written affiliate, employee and contractor arrangements, including applicable acceptance records and intercompany R&D/IP/NDA/DPA arrangements. This Policy does not itself transfer copyright; open-source, third-party licensed, public-domain and unprotectable elements are excluded from exclusive claims.

The Policy also covers copyright complaints relating to material made available through customer-operated internet-store messaging and support integrations, to the extent that the material is hosted or controlled by Beyonder. It does not confer authority to remove content held exclusively by an independent messaging provider or internet store.

2. Designated agent

Daryn Lab’s designated agent to receive notifications of claimed infringement is: Daryn Lab Inc., Attn: DMCA Agent, 48 Wall Street, Suite 1100, Unit 1023, New York, NY 10005, United States of America; email: [email protected]. Registration of the designated agent with the U.S. Copyright Office is in progress; this section will be updated with the registration details once it is complete.

3. Infringement notice requirements

A written notice should include: (a) physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work or representative list; (c) sufficiently precise identification and URL of allegedly infringing material; (d) contact address, telephone and email; (e) statement of good-faith belief that the use is not authorized by the owner, agent or law; and (f) statement, under penalty of perjury, that the notice is accurate and the sender is authorized. Incomplete notices may delay action. Knowingly material misrepresentations may create liability under 17 U.S.C. § 512(f).

4. Review and action

Daryn Lab will review notices in good faith, may request clarification and may expeditiously disable access to or remove identified material when legally appropriate. Where practicable, it will notify the affected customer and preserve a record of the notice and action. Urgent threats or other unlawful material may be handled under separate abuse rules. Removal does not necessarily imply a finding of infringement. The proposed human-reviewed workflow includes complaint intake and validation, material identification, proportionate access restriction, customer notice, counter-notice handling, deadline tracking and lawful restoration. Restricting particular content and deleting an entire application are distinct actions; irreversible deletion of an entire application on the first complaint is not the default.

Where a complaint concerns a store conversation or attachment, Daryn Lab will identify the material and assess whether proportionate restriction is technically possible within its service, while coordinating with the store and, where necessary, the independent channel provider. A complaint does not automatically justify deleting an entire store integration or unrelated shopper records.

5. Counter-notice

A customer believing removal resulted from mistake or misidentification may submit a written counter-notice containing: signature; identification of removed material and prior location; statement under penalty of perjury of good-faith belief in mistake or misidentification; name, address and telephone; and consent to jurisdiction of the relevant US federal district court (or, if outside the US, an appropriate district in which Daryn Lab may be found) and acceptance of service from the original claimant or agent. Daryn Lab will forward a valid counter-notice to the original notifier as required.

6. Restoration procedure

Subject to 17 U.S.C. § 512(g), Daryn Lab may restore removed material no less than 10 and no more than 14 business days after receipt of a valid counter-notice, unless its designated agent first receives notice that the claimant filed an action seeking a court order to restrain the allegedly infringing activity. Restoration may remain unavailable for independent security or legal grounds.

7. Repeat infringers and other remedies

Daryn Lab adopts and reasonably implements a policy for termination, in appropriate circumstances, of accounts of repeat copyright infringers, and accommodates standard technical measures where required. Relevant factors include valid notices, counter-notices, patterns of conduct and abuse. Daryn Lab may also act under its Terms of Service. References to the Acceptable Use Policy apply only once that policy is approved and available.

8. Customer responsibilities and privacy

Customers must possess necessary rights for materials they upload, generate, publish or distribute and must respond to end-user copyright claims concerning their own applications. Notices and counter-notices may be shared with affected parties as legally necessary. Personal information submitted in copyright proceedings is processed in accordance with the Privacy Policy.

Customer-supplied works remain with their lawful owners. A platform access license does not authorize infringement of third-party rights.

The store remains responsible for rights and permissions in promotional content, product imagery and customer-facing messages it supplies or directs. Copyright complaint records must be limited to what is necessary for the procedure and handled under the Privacy Policy and applicable retention obligations.

9. Contact and effective date

Copyright notices: [email protected] (subject line “DMCA notice”). Daryn Lab Inc., a Delaware corporation (File No. 10457519), 48 Wall Street, Suite 1100, Unit 1023, New York, NY 10005, United States of America. Effective date: 8 November 2026. Version 2.0.

Ordinary contractual disputes follow the New York law and New York County forum provisions of the General Terms, except where a separately signed Enterprise agreement chooses ICDR or ICC arbitration seated in New York.
